Florida DUI Penalties

Florida law defines penalties for the first, second, third, and fourth DUI convictions. Any subsequent convictions are penalized the same as the fourth violation under the law. First, second, and third DUI violations can also be enhanced if they happened within a specific time period, the BAC is above 0.15, or if a minor is in the vehicle at the time of arrest. The penalties for DUI are harsh even for a first time offender, and the punishments only increase with successive DUIs. DUI Fines

First offense: $500 to $1,000

First offense enhanced: $1,000 to $2,000

Second offense: $1,000 to $2,000

Second offense enhanced: $2,000 to $4,000

Third offense: $2,000 to $5,000

Third offense enhanced: At least $4,000

Fourth offense: At least $2,000

DUI Community Service

First offense: Minimum 50 hours, can pay $10/hour if service is an undue hardship

DUI Imprisonment

First offense: Up to six months

First offense enhanced: Up to nine months

Second offense: Up to nine months

Second offense enhanced: Minimum of ten days, 48 hours served consecutively, up to one year

Third offense: Up to one year

Third offense enhanced: Minimum thirty days, 48 hours served consecutively, up to five years

Fourth offense: Up to five years

DUI License Revocation

First offense: Minimum of 180 days, up to one year

Second offense: Minimum of 180 days, up to one year

Second offense enhanced: Minimum of five years

Third offense: Minimum of 180 days, up to one year

Third offense enhanced: Minimum of ten years

Fourth offense: Permanently revoked

DUI Probation

First offense: Up to one year

Second offense: Up to one year

Third offense: Up to one year

Fourth offense: Up to five years

DUI Vehicle Impoundment

First offense: Up to ten days for all vehicles owned by offender

Second offense: Up to thirty days for all vehicles owned by offender

Third offense: Up to ninety days for all vehicles owned by offender

Fourth offense: Up to ninety days for all vehicles owned by offender

DUI Ignition Interlock Device

First offense: Up to six months

Second offense: Minimum of one year

Third offense: Minimum of two years

DUI School

First offense: Level I DUI School – 12 hours of instruction and psychosocial evaluation

Second offense: Level II DUI School – 21 hours of instruction and psychosocial evaluation

Third offense: Level II DUI School – 21 hours of instruction and psychosocial evaluation
